Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Give It Up ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Naim OUDAYET ("Developer", "we", "us").

2. Description of the App

Give It Up is a habit-tracking mobile application designed to help users track habits they wish to quit. The App provides features including goal tracking, daily check-ins, streak counting, milestone recognition, and data visualisation.

Give It Up is not a medical application. It is not a substitute for professional medical advice, diagnosis, or treatment. If you are quitting an addiction (including tobacco, alcohol, or controlled substances), please consult a qualified healthcare professional.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a mobile device you own or control, for personal, non-commercial purposes.

You may not:

• Copy, modify, distribute, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal or unauthorised purpose
• Attempt to circumvent or bypass any in-app purchase requirements
• Remove or alter any proprietary notices or labels on the App

4. In-App Purchases and Subscriptions

Give It Up offers optional in-app purchases:

• Pro Monthly — auto-renewing monthly subscription
• Pro Yearly — auto-renewing annual subscription
• Pro Lifetime — one-time purchase, no expiry, does not renew

Prices are shown in the App in your local currency before you confirm, and are set by the store for your country. Payment is charged to your store account when you confirm the purchase.

Auto-renewal. Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. The Lifetime option is a single payment and never renews.

Managing and cancelling. You can manage or cancel a subscription at any time in your store account settings — Google Play → Subscriptions, or the App Store → your account → Subscriptions. Cancelling stops future renewals; the current paid period runs to its end. Deleting the App does not by itself cancel a subscription.

Refunds. All purchases are handled by the store you bought through. Refund requests must go through that store's standard refund process. We cannot issue refunds directly.

Restoring. Pro is tied to the store account used for the purchase and is non-transferable. Use "Restore Purchase" in the App to recover access on a new device with the same account.

5. User Content

All content you enter into the App (goal names, notes, check-ins) is stored locally on your device. You retain full ownership of your data. We have no access to, and make no claim over, content stored on your device.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Any defects or errors will be corrected
• The App will help you successfully quit any habit

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability to you for all claims shall not exceed the amount you paid for the App in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted by law, and nothing in these Terms affects your statutory consumer rights.

8. Health Disclaimer

Give It Up is a self-help tool for personal habit tracking. It is not a medical device, medical application, or healthcare service. The App does not provide medical advice.

Quitting certain substances (alcohol, tobacco, drugs, medications) can have serious health implications, and abrupt withdrawal from some substances can be dangerous. Always consult a qualified healthcare professional before making changes to your health behaviours, especially when quitting addictive substances. If you are in crisis or believe you may be experiencing a medical emergency, contact your local emergency services.

9. Third-Party Services

The App uses your app store's billing service (Google Play Billing or the Apple App Store) for in-app purchases. Your use of those services is governed by that provider's terms and privacy policy. We are not responsible for the practices of any third-party service.

10. Intellectual Property

The App, including its design, code, text, graphics, and all other content, is owned by Naim OUDAYET and protected by applicable intellectual property laws. All rights not expressly granted to you in these Terms are reserved.

11. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We may also update these Terms at any time. Continued use of the App after changes to these Terms constitutes acceptance of the updated Terms.

12. Termination

These Terms are effective until terminated. Your rights under these Terms will automatically terminate if you fail to comply with any of its terms. Upon termination, you must stop all use of the App and delete all copies from your devices.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved in the competent courts of the jurisdiction where the Developer is located. Nothing in this section deprives you of the protection of mandatory consumer-protection law in your country of residence.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
